Registration Agreement — Applies to All LueinHire Account Types
Office: Luein Hire a product of LUEIN ANALYTICS RESEARCH AND CONSULTING (OPC) PRIVATE LIMITED, having its registered office and principal place of business LUEIN ANALYTICS RESEARCH AND CONSULTING (OPC) PRIVATE LIMITED #677, 1st Floor, 27th Main, 13th Cross, HSR Layout, Sector-1, Bangalore, Karnataka, 560102, to be referred to hereinafter as: "LueinHire", "we," "us," or "our."
Article 1: Introduction and Scope
These General Terms & Conditions ("Terms") govern registration and use of the LueinHire website and platform (the "Services") by every person or organisation that creates an account with us, regardless of account type. These Terms apply in addition to — not instead of — the specific agreement that governs your account type, referenced in Article 4 below.
These Terms are governed exclusively by the laws of India, as set out in Article 16.
Article 2: Definitions
- "Account" means a registered LueinHire account of any type — Employer, Institute/TPO, or Candidate.
- "Candidate" means an individual — a job applicant or a student referred by an Institute — whose interviews, assessments, resumes, or other personal data are processed through the Services.
- "Employer" means a business or organisation that uses the Services to source, assess, and hire Candidates, and is bound by the Terms of Service.
- "Institute" or "TPO" means a college, university, training provider, coaching centre, or Training & Placement Office that uses the Services to assess its own enrolled students, and is bound by the Institute & TPO Terms of Service.
- "Content" means any text, video, audio, image, document, or other material submitted to or generated through the Services, including interview recordings, resumes, and AI-generated scores or reports.
- "Applicable Law" means the laws of India, including any rule, regulation, order, or directive issued by an Indian governmental or regulatory authority.
- Capitalised terms not defined here have the meaning given to them in the agreement applicable to your account type (see Article 4).
Article 3: Acceptance, Eligibility, and How These Terms Are Accepted
3.1. These Terms are presented as a mandatory checkbox at the point of registration for every account type — Employer, Institute/TPO/Coaching Centre, and Candidate (student or working professional). You must affirmatively read or check the box confirming you have read and agree to these Terms, together with the specific agreement applicable to your account type, before an account can be created. We keep a record of that acceptance, including the version accepted and the date.
3.2. The Services are intended only for individuals 18 years of age or older. If you are registering as a Candidate directly, you represent that you are 18 or older. If you are registering on behalf of an Employer or Institute, you represent that you are authorised to bind that organisation, and that organisation separately represents — in the Terms of Service or Institute & TPO Terms of Service, as applicable — that every individual it invites through its Account is 18 or older.
3.3. If we later determine that an Account was created by, or on behalf of, someone under 18, we will suspend the Account and delete the associated personal information, consistent with Section 7.1 of the Privacy Policy.
3.4. If you do not agree to these Terms, you must not check the acceptance box, and you will not be able to register for or use the Services.
Article 4: Relationship to Other LueinHire Policies
These Terms work alongside the following documents, which are incorporated by reference. Where these Terms and a more specific document conflict on a matter that document is designed to govern, the more specific document controls for that matter.
- Employers: Terms of Service — commercial terms, billing, and Employer-specific obligations.
- Institutes/TPOs/Coaching Centres: Institute & TPO Terms of Service — commercial terms, batch/cycle billing, and Institute-specific warranties.
- Candidates (students and working professionals): Candidate Terms of Use — recording, AI scoring, and certificates.
- Everyone: Privacy Policy and Refund Policy.
- Employers and Institutes: Service Level Agreement and Cancellation Policy.
Article 5: Use of the Services
5.1. Subject to your compliance with these Terms and the agreement applicable to your account type, LueinHire grants you a limited, non-exclusive, non-transferable right to access and use the Services for their intended purpose — hiring and assessment for Employers and Institutes, and interviewing/assessment participation for Candidates.
5.2. You are responsible for all activity under your Account, including activity by anyone you authorise to access it. Notify us immediately at support@lueinhire.com of any unauthorised use or suspected security breach.
5.3. We may update or change features of the Services from time to time. We will not reduce the core functionality you have paid for during a billing period without reasonable notice, except where required for security, legal compliance, or maintenance.
Article 6: Acceptable Use
You must not, in connection with the Services:
- post or transmit fake job listings, or request payment from a Candidate in exchange for a job offer or interview opportunity;
- share content that is unlawful, infringes another person's rights, is harmful, defamatory, or deceptive;
- send spam, or engage in identity theft, impersonation, or unauthorised use of another person's Account;
- attempt to interfere with, disrupt, or gain unauthorised access to the Services, including through hacking, denial-of-service activity, or introducing malware;
- systematically scrape, retrieve, or reuse a substantial part of the data made available through the Services, other than as permitted by the agreement applicable to your account type;
- use the Services for any purpose that violates Applicable Law.
If you become aware of a violation of this Article by anyone using your Account, you must act promptly to remedy it, including by suspending that person's access where you control it. We may take any of the actions described in Article 14 in response to a suspected violation, and we are not obliged to notify you before doing so where immediate action is reasonably necessary.
Article 7: Academic and Assessment Integrity
7.1. A Candidate using the Services for any interview, assessment, or evaluation must not:
- impersonate another individual, or allow another individual to complete any part of an assessment on their behalf;
- use unauthorised aids or external assistance during an assessment where the assessment format indicates such aids are not permitted;
- share their personal OTP, invite link, or other unique access credential with anyone else;
- misrepresent AI-assisted or third-party-generated resume or application content as their own unassisted work.
7.2. Where we reasonably determine — including through our own detection systems or a report from an Employer or Institute — that a Candidate has violated clause 7.1, we may, at our discretion, void the affected score, assessment result, or certificate, and suspend or terminate that Candidate's access to the Services.
7.3. An Employer or Institute that becomes aware of a suspected violation of clause 7.1 by a Candidate it has invited must report it to support@lueinhire.com, and must not rely on, publish, or otherwise act on a score or certificate it reasonably suspects is affected by such a violation.
Article 8: Content and Intellectual Property
8.1. LueinHire and its licensors own all right, title, and interest in the Services, including the underlying software, platform design, and LueinHire branding. Nothing in these Terms transfers any of that ownership to you.
8.2. As between you and LueinHire, you or the individual who created it retains ownership of Content you submit (such as a resume or interview recording), consistent with the "Customer Data" ownership principle set out in the Terms of Service. You grant LueinHire the right to use that Content to provide, secure, and improve the Services, and as otherwise described in the Privacy Policy.
8.3. You must not remove or alter any copyright, trademark, or other proprietary notice included in the Services.
Article 9: Confidentiality
Each party must keep confidential any non-public information it receives from the other in connection with the Services, and use it only for the purposes contemplated by these Terms and the agreement applicable to your account type. This obligation does not apply to information that is or becomes publicly available other than through a breach of this Article, or that a party is required to disclose by Applicable Law.
Article 10: Third-Party Links and Services
The Services may link to, or interoperate with, websites or services operated by third parties, including Employers, Institutes, Channel Partners, or payment processors such as Razorpay. We are not responsible for the content, policies, or practices of any third-party website or service, and any information you provide directly to a third party is governed by that third party's own terms.
Article 11: Disclaimers
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by Applicable Law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation of the Services, and we make no representation regarding the accuracy, dependability, or completeness of any AI-generated score, profile, or assessment — these are automated outputs, not certified psychological or professional evaluations, as further explained in the Candidate Terms of Use.
Article 12: Limitation of Liability
12.1. To the fullest extent permitted by Applicable Law, LueinHire's cumulative liability to you for any claim arising out of or relating to the Services is limited to the total fees you paid to LueinHire for the specific service giving rise to the claim in the three (3) months preceding the event, or, for Employer and Institute Accounts, the amount specified in the Terms of Service or Institute & TPO Terms of Service, whichever applies to your account type.
12.2. LueinHire is not liable for indirect, incidental, special, punitive, or consequential damages, including loss of profits, goodwill, or data, arising out of or relating to the Services, even if advised of the possibility of such damages.
12.3. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under Applicable Law, including liability for fraud, wilful misconduct, or any right you hold as a consumer under the Consumer Protection Act, 2019.
Article 13: Indemnification
You agree to defend, indemnify, and hold harmless LueinHire and its affiliates against any third-party claims and resulting losses arising from your breach of these Terms, the agreement applicable to your account type, or Applicable Law, or from your misuse of the Services.
Article 14: Suspension and Termination
14.1. We may suspend or terminate your Account, without liability to you, if you fail to comply with these Terms or the agreement applicable to your account type, if we reasonably suspect fraudulent, unlawful, or abusive use, if required by Applicable Law, or where continued access poses a security risk to the Services or other users.
14.2. Where reasonably possible, we will give you advance notice and an opportunity to cure before suspending or terminating your Account; immediate suspension may occur without notice where we reasonably believe it is necessary to protect the Services or other users.
14.3. You may close your Account at any time by writing to support@lueinhire.com, subject to any outstanding obligations under the agreement applicable to your account type.
Article 15: Force Majeure
Neither party is liable for any delay or failure to perform its obligations under these Terms where that delay or failure results from circumstances beyond its reasonable control, including natural disasters, internet or power failures, war, epidemic or pandemic, strikes, acts of a Government Authority, or sudden policy changes by an educational Institute affecting a batch of Candidates.
Article 16: Governing Law and Dispute Resolution
These Terms, and any dispute arising out of or in connection with them or the Services, are governed exclusively by the laws of India. Any such dispute shall be resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Bangalore, India, consistent with the Terms of Service.
Article 17: General Provisions
17.1. Relationship of the parties: nothing in these Terms creates a partnership, joint venture, or agency relationship between you and LueinHire.
17.2. Assignment: you may not assign or transfer your Account or rights under these Terms without our prior written consent.
17.3. Severability: if any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force.
17.4. No waiver: our failure to enforce any provision of these Terms is not a waiver of that provision.
17.5. Notices: we may send legal notices and other communications to the email address associated with your Account. You agree that this satisfies any requirement for notice in writing.
17.6. Entire agreement: these Terms, together with the agreement applicable to your account type and the other policies referenced in Article 4, constitute the entire agreement between you and LueinHire regarding the Services.
Article 18: Amendments to These Terms
We may amend these Terms from time to time. The current version will always be published at this URL. Where a change is material, we will seek fresh acceptance from existing users where required by Applicable Law; otherwise, continued use of the Services after an amendment is posted constitutes acceptance of the amended Terms.
